Roqqu – General Risk Disclosure Statement
1. Introduction
This Risk Disclosure Statement (“ Statement”) sets out certain risks associated with the use of Roqqu (the “Platform”) and the services made available through it, including but not limited to spot trading, futures and derivatives trading, custody, transfers, and related services (the “Services”). This Statement does not purport to disclose or explain all risks or all aspects of such risks. You should carefully consider whether the Services are appropriate for you in light of your financial condition, objectives, level of experience, and risk tolerance.
By accessing or using the Platform, you acknowledge that you have read, understood, and accepted this Statement and that you assume all risks associated with your use of the Services. Your capital is at risk, and you may lose the entirety of your funds.
2. No Advice and No Fiduciary Relationship
Roqqu does not provide investment, financial, legal, or tax advice. Nothing on the Platform constitutes, or should be construed as, advice, a recommendation, or an offer to buy or sell any digital asset or financial instrument. Roqqu is not your broker, intermediary, agent, or advisor and does not owe you any fiduciary duties.
Roqqu does not monitor your transactions or assess the suitability of any activity for your financial circumstances. All decisions to access or use the Services are made solely by you, and you are solely responsible for determining whether any transaction, strategy, or use of the Services is appropriate for you.
3. General Market Risk
Digital asset trading is highly speculative and involves a high degree of risk. Prices are volatile and may fluctuate significantly over short periods of time due to factors that may be foreseeable or unforeseeable. Such factors include, but are not limited to, changes in supply and demand, market sentiment, technological developments, regulatory changes, macroeconomic conditions, and events affecting the broader financial markets.
There is no assurance that any digital asset will maintain its value, and you may lose all or part of your investment. Past performance is not indicative of future results.
4. Risks Associated with Digital Assets
Digital assets are subject to inherent technological, operational, and security risks. These include, without limitation, risks arising from software vulnerabilities, coding errors, protocol failures, cyberattacks, and other malicious activities. The underlying technologies, including blockchain networks, may be subject to delays, congestion, forks, rollbacks, or other disruptions that may adversely affect the functionality or value of digital assets
Transactions in digital assets are generally irreversible. Accordingly, losses resulting from unauthorized, fraudulent, or mistaken transactions may not be recoverable. The value of digital assets may also be affected by market perception, including negative publicity or loss of confidence in the digital asset ecosystem.
5. Futures and Leveraged Trading Risk
Futures and derivatives trading are complex, high-risk activities and may not be suitable for all users. These products typically involve leverage, which magnifies both potential gains and potential losses. Even small movements in the price of an underlying asset may result in significant losses, including the loss of all margin or collateral allocated to a position.
You may be required to provide additional margin at short notice to maintain open positions. Failure to do so may result in the liquidation of your positions, potentially at a loss. In certain circumstances, you may incur losses exceeding your initial investment. Market conditions may prevent the execution of orders at desired prices or at all. You may lose your digital assets due to cybersecurity incidents, operational failures, system errors, insolvency events, or other unforeseen circumstances.
Transfers of digital assets to incorrect addresses or networks may result in permanent and irreversible loss. Roqqu does not guarantee the recovery of any lost assets.
8. Third-Party Risk
The provision of the Services may involve third-party service providers, including but not limited to payment processors, liquidity providers, banking partners, and infrastructure providers. Such third parties operate independently and may be subject to their own terms and conditions.
Roqqu does not control and is not responsible for the acts, omissions, or failures of any third-party service provider and shall not be liable for any loss arising from or in connection with services provided by such third parties, except where expressly required by applicable law.
9. Cybersecurity Risk
The Platform and digital asset ecosystem are subject to cybersecurity risks, including unauthorised access, hacking, phishing, malware, and denial-of-service attacks. While Roqqu implements security measures designed to protect the Platform and user accounts, no system can be guaranteed to be completely secure.
You are solely responsible for maintaining the confidentiality and security of your account credentials. Any unauthorised access to your account may result in irreversible loss, for which you bear full responsibility.
10. Operational and System Risk
Roqqu may experience system failures, disruptions, or downtime due to maintenance, technical issues, or events beyond its control. Such events may result in delays, interruptions, or the inability to access the Platform or execute transactions.
Roqqu does not warrant that the Platform will be available at all times or free from errors and shall not be liable for losses resulting from system failures, delays, or interruptions.
11. Regulatory and Legal Risk
The regulatory status of digital assets and related services is uncertain and subject to change. Changes in laws, regulations, or regulatory interpretations may adversely affect the availability, legality, or value of digital assets and the Services.
Digital assets may not be recognised as property or financial instruments in certain jurisdictions. You are solely responsible for ensuring that your use of the Services complies with all applicable laws, regulations, and obligations in your jurisdiction.
12. Counterparty Risk
You may be exposed to counterparty risk where other participants in the market, liquidity providers, or intermediaries fail to perform their obligations. This may result in delayed, failed, or reversed transactions and may lead to financial loss.
13. Access and Connectivity Risk
Access to the Platform depends on internet connectivity, communication networks, and compatible devices. Interruptions, latency, or failures in these systems may affect your ability to access the Platform or execute transactions in a timely manner, which may result in losses.
14. API and Automated Trading Risk
The use of APIs, trading bots, or other automated systems involves additional risks, including errors in programming, system failures, or unintended execution of trades. Roqqu does not guarantee the performance of any automated trading system and shall not be liable for any losses arising from their use.
15. Currency Risk
Where transactions involve fiat currencies, exchange rate fluctuations may impact the value of your assets, gains, or losses. Currency conversion rates may vary and are subject to factors beyond the control of Roqqu.
16. Acknowledgment and Assumption of Risk
By accessing or using the Platform, you acknowledge that you understand the nature of the Services and the risks involved and that you voluntarily assume all risks associated with your use of the Platform. You further acknowledge that you are solely responsible for any losses incurred and that you are financially able to bear such losses, including the total loss of your funds.
