Guidance Note: Handling Requests for Information (RFIs) from Law Enforcement
At Roqqu, we are committed to protecting the privacy and security of our users while complying with all applicable laws and regulatory obligations in the jurisdictions where we operate. This guidance outlines how Roqqu handles Requests for Information (RFIs) from law enforcement and competent authorities.
1. Legal Basis for Information Disclosure
Roqqu only discloses user data to law enforcement or regulatory agencies when:
- Required by a valid legal request under applicable laws and regulations (e.g., court orders, subpoenas, regulatory directives).
- The request is clear, specific, and within the legal powers of the requesting agency.
- Disclosure is necessary to meet obligations under Anti-Money Laundering (AML), Counter-Terrorist Financing (CTF), or other relevant legal frameworks.
2. How to Submit a Request
Law enforcement and competent authorities may submit RFIs through any of the following channels:
- Email: compliance@roqqu.com / legal@roqqu.com
- Subject line: "Law Enforcement Request – [Agency Name]"
Please ensure all requests:
- Are submitted on official letterhead.
- Clearly state the name, position, and contact details of the requesting officer.
- Include the legal authority or relevant legislation under which the request is made.
- Specify the type of information sought (e.g., transaction records, KYC data, IP logs).
- Identify the user or subject in question (e.g., email address, transaction ID, wallet address).
- Indicate any deadlines or urgency, if applicable.
3. Assessment and Processing of Requests
Upon receipt of an RFI, Roqqu will:
- Verify the identity and authority of the requesting party.
- Assess the legal validity and scope of the request.
- Review the information requested to ensure it is proportional and necessary.
- Respond in a timely and secure manner.
Where clarification is needed, Roqqu may contact the requester directly.
4. User Notification
Roqqu reserves the right to notify affected users before disclosing their data unless:
- Prohibited by law (e.g., where a gag order or non-disclosure requirement applies).
- There is a risk of harm to an investigation or individual.
6. Data Retention and Preservation
If immediate disclosure is not possible, Roqqu may, upon receiving a lawful preservation request, retain relevant data for a defined period pending the submission of a valid legal request.
